General Terms and Conditions of Sale of SAS La Compagnie de Bouteville
Article 1 – Purpose
These general terms and conditions of sale (hereinafter "GTC") apply to all sales of products made by SAS La Compagnie de Bouteville, a company specializing in the sale of condiments and delicatessen products, to consumers, either directly or via its website http://www.bouteville.com (hereinafter the "Site"). Any order placed implies the customer's unreserved acceptance of these GTC.
Article 2 – Products
The products offered for sale are those listed in our brochures and on the website at the time of placing the order, subject to availability. The essential characteristics of the products are available in our technical data sheets (upon request) or, where applicable, on the Website. The photographs illustrating the products are for information purposes only and are not contractually binding.
Article 3 – Price
Product prices are indicated in euros, inclusive of all taxes (TTC), excluding shipping costs. They are subject to change at any time, on the understanding that products will be invoiced on the basis of the prices in effect at the time the order is confirmed.
Article 4 – Ordering
To place an order, the customer must create an account either with our teams or directly on the Website and follow the instructions provided. Confirmation of the order constitutes acceptance of these Terms and Conditions.
When placing an order online, the customer explicitly acknowledges their obligation to pay by clicking on the "Pay now" button .
Article 5 – Payment
Orders can be paid for by credit card, bank transfer, or PayPal. For orders placed on the Website, payment must be made in full before the order is shipped.
⚠️ The provisions relating to late payment penalties and fixed recovery fees do not apply to consumers.
For orders from professionals who have opened a specific account (with bank details, KBIS, signed terms and conditions), the standard payment method is bank transfer within 30 days of the invoice date. In addition, the first order must be paid for before dispatch.
Discount codes are only applicable to the value of the products, which must be at least equal to the value of the voucher and cannot be applied to shipping costs. This offer cannot be combined with other offers. Discount codes are not retroactive and cannot be applied once the order has been placed. Discount codes offering free products are valid while stocks last. Discount codes are valid until their expiration date.
Article 6 – Delivery
Products are delivered to the address provided by the customer when placing the order. Shipping costs are payable by the customer and are calculated based on the weight and destination of the order. Delivery times are provided for informational purposes only. The carrier is responsible for any loss or damage to goods from the moment the order is picked up.
Article 6.1 – Late delivery
In the event of a delay in delivery, SAS La Compagnie de Bouteville cannot be held liable if this delay is due to force majeure, an act of the carrier, or any other cause beyond its control.
Article 7 – Right of withdrawal
In accordance with Articles L.221-18 et seq. of the French Consumer Code, the customer has a period of 14 days from receipt of their order to exercise their right of withdrawal without having to justify their reasons or pay penalties, with the possible exception of return shipping costs.
A standard withdrawal form is available in the appendix to these Terms and Conditions.
We will refund the product(s) concerned within a maximum of 14 days, subject to receipt of the returned products. Returns must be made in their original condition and complete.

If we do not receive the returned products within 14 days, we will defer the refund until we receive them.
Return shipping costs are the responsibility of the buyer.
In accordance with Article L.221-28 of the Consumer Code, the right of withdrawal does not apply to products that have been unsealed after delivery and cannot be returned for reasons of hygiene or health protection, nor to products after their expiration date.
Article 8 – Product conformity and legal warranties
The products delivered comply with the descriptions appearing on the Website. The seller is bound by the legal guarantees of conformity and hidden defects provided for in Articles L.217-4 et seq. of the French Consumer Code.
Article 9 – Liability
SAS La Compagnie de Bouteville cannot be held liable in the event of non-performance or poor performance of the contract due to force majeure, in particular in the event of disruption or interruption of supply, total or partial strikes affecting, in particular, means of transport or communications, flooding, fire, or any other event beyond its control.
Article 10 – Personal Data
The personal data collected during the ordering process is necessary for the fulfillment of the order and for customer relationship management. It is processed in accordance with our privacy policy, which is available on the Website.
In accordance with Article L.223-2 of the French Consumer Code, customers are informed of their right to register free of charge on the Bloctel cold calling opt-out list (www.bloctel.gouv.fr).
Article 11 – Mediation
In accordance with Article L.612-1 of the Consumer Code, the customer has the right to use a mediation service free of charge.

Article 12 – Applicable law and competent jurisdiction
These Terms and Conditions are subject to French law.
In the event of a dispute, the consumer may choose to refer the matter to the court of their place of residence, the court of the place where the contract was concluded, or the court of the place where the harmful event occurred (Article R.631-3 of the Consumer Code).
